These creations are for personal use as outlined below. They are not to be redistributed in any way, used for commercial purposes, or claimed as your own.
PERMITTED USES:
(a) You may use and incorporate the Content in your personal scrapbooking layouts;
(b) You may alter Content by changing the size, color, adding to or deleting from said Content.
(c) You may use and incorporate the Content in scrapbooking layouts you create for others, whether or not you make a profit, provided that the layouts are provided to the client as a flattened, non-editable form either electronic (jpg) or printed. You may not provide the editable pieces of the kit to anyone else under any circumstances. Quick Pages, blog templates and desk tops are not considered flattened and non-editable. I do not give permission for my items to be used to create such products.
(d) You may use portions of this kit in your layouts that are submitted to scrapbooking and/or related magazines and e-zines for publication as long as proper credit is given to J. Conlon and Sons and a link is provided to www.jconlonandsons.com. Credit for usage in an online gallery is appreciated, but not required.
(e) You may print a hard copy of Content to be used in your personal scrapbooking projects.
(f) You may make a copy of the Content solely for back-up purposes; you must reproduce all proprietary notices on this back-up copy;
(g) You may use my products for tutorials. You must direct your readers to my site(s) to upload or purchase the product. Sharing of my products is not allowed in any form. If you have a large group that will be using an item for purchase, please contact me in advance. I would be happy to issue a coupon to your group for a discounted purchase.
PROHIBITED USES:
You may not do anything with the content that is not expressly permitted. You may not provide a copy of the Content, or any portions thereof, to anyone or allow anyone to gain access to the Content, or any portion thereof, except as permitted above. For greater certainty, you may not:
You may not RESELL or redistribute my designs as clip art, digital scrap elements/papers/alphas/templates/quick pages on any site or in any store.
(a) You may not use the content in design template applications for resale, including, without limitation, website templates, flash templates, and brochure design templates;
(b) You may not create print on demand items of any kind using my designs. You may not display the content on websites designed to induce sales of “print on demand” products, including candy wrappers, note cards, book marks, postcards, mugs, t-shirts, posters and other items (this includes custom design websites as well as sites such as (but not limited to) Cafe Press, Etsy, Teachers Pay Teachers, etc);
(c) You may not claim content or altered content as your own. You may not alter these graphics and call them your own. You may not take any part of these graphics and add it to your graphic and claim the resulting graphic as your own.
(d) You may not use the content or any part thereof as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo;
(e) You may not incorporate the content in any product that results in a re-distribution of the Content (such as electronic greeting card web sites);
(f) You may not use the Content in a fashion that is considered pornographic, obscene, defamatory or libelous in nature;
(g) You may not use any image in the content that depicts a person to endorse a business, product or service;
(h) You may not remove any notice of copyright, trade-mark or other proprietary right from any place where it appears on or in the Content or its accompanying materials;
(i) You may not sub-license, resell, rent, lend, include designs as part of a kit club or membership program or otherwise distribute the Content;
(j) You may not post a copy of the Content on a network server or web server for use by other users; or
(j) You may not transfer the rights to the Content or accompanying materials (if applicable), except as specifically provided for elsewhere in this Agreement.
(k) You may not make any Content into tubes or brushes and redistribute them in any way.
(l) You may not offer Content on any web page for download, send them through a list such as a news or Yahoo group or include them in any graphics collection either on the internet or otherwise. This includes any thing that you would deem as Fair Use. There is no reasonable application of scrapbooking materials that would fall under “Fair Use” guidelines.
(m) You may not provide the editable pieces of the kit to anyone else under any circumstances.
(n) You may not use content to create Quick Pages, Desk Tops, blog backgrounds or any other item that is intended to be sold or given to the general public as a “freebie” on a blog or any other website. You may make these items for your personal use, however, you may not share them without first obtaining my permission.
Clarification on Commercial Use:
You may use my products to create scrapbook pages or other individualized items for gifts or for sale for others provided that you deliver the item in a flattened (.jpg) format. Each item created by you for others must be customized for each individual. You may not create templates, quick pages, cards, candy wrappers, or any other print on demand item and advertise that specific item as a freebie or for sale. This would be considered commercial use and is not allowable. I do not currently offer a commercial use license for this type of use of my designs.
